The advice offered is given in good faith. Fenland Frames will accept no responsibility whatsoever for any form of loss or damage of any kind including direct, consequential, incidental, special, punitive or any other damages whatsoever and howsoever caused as a result of any action or inaction as a direct or indirect result of any person reading or consuming in any way any content, textural or otherwise, contained herein.
FRAMING TERMS & CONDITIONS
Prices are correct at the time of publishing but they are liable to change without any notification and we reserve the right to charge the prices current at the time of receiving an order.
All orders must be paid for in full before they can be collected or despatched.
While we always endeavour to meet deadlines Fenland Frames can accept no liability for failure to do so, or for any consequential costs or inconvenience incurred by the customer.
All timings given for deliveries or collection of work will be understood to be approximate.
Although every care and attention is given to any work left with us for framing all customers are advised to take their own precautions to ensure their work is fully covered against loss or damage.
Customers providing their own materials for us to work do so on the understanding that Fenland Frames cannot be held responsible for any mistakes or accidents which may occur to those materials.
Fenland Frames will not be held responsible for any loss, damage or inconvenience caused by the use of any items provided by Fenland Frames beyond the replacement of goods deemed to be faulty. At no time will Fenland Frames’s liability exceed the price paid for the items purchased.
Fenland Frames reserves the right to require full payment before commencing work on any order.
While we always endeavour to ensure that any estimate we give is as accurate as possible the final price for any work cannot be confirmed until a firm order is placed.
Due to technical limitations of machinery our tolerance parameters are +/-2mm. While most work will be far more accurate we are unable to guarantee higher precision than this. If you require higher precision this must be stated at the time of placing an order and we will price the work accordingly or advise that it is not possible.
The grain of wood varies from piece to piece. While great care is taken to select matching timber we cannot guarantee complete matching (particularly on large frames), freedom from knots & other natural figuring, or that frames will match the grain of sample pieces.
Stain samples are an approximate indicator of frame colour; we cannot guarantee exact matching. Final frame colour will depend on the base wood colour. Please note that the colour of wood changes with age & this will in turn affect stain colours. Many stains are dye based and will also be affected by the level of exposure to light.
Indemnity.
You shall indemnify Fenland Frames against all liabilities, claims, demands, damages, losses, costs and expenses which may be incurred or brought against Fenland Frames in respect of injury to any person or loss or of damage to any property arising out of or in connection with the use by you of the goods and/or services as a result of any negligent act or omission by you or of any breach by you of any of your obligations hereunder.
Liability.
(a) Fenland Frames will not be held liable for loss or damage consequential or otherwise in respect of goods and services supplied by them. (b) All or any artwork and/or other goods supplied by you or any third party to Fenland Frames are supplied entirely at your own risk and will remain at your risk while in Fenland Frames’ custody and Fenland Frames will not be held liable for any loss or damage consequential or otherwise to such artwork and such goods.
Insurance.
You should arrange and maintain adequate insurance to cover your responsibilites imposed by these Terms of Trade including without limitations all risks insurance at the full replacement value of any and all artwork and/or other goods supplied by you or any third party to Fenland Frames and for the avoidance of doubt you should maintain such insurance during transportation of such artwork and such goods and of the goods supplied by Fenland Frames hereunder.
Delivery/Collection.
Where it is agreed that Fenland Frames will arrange transportation of the goods to be supplied by them hereunder and/or any artwork and/or other goods supplied by you or any third party; (i) the delivery instructions relating thereto will be as agreed (ii) transportation thereof will be carried out at your own risk, expense and insurance liability.
Security of Property.
Fenland Frames will make reasonable endeavours to provide a secure area(s) for any artwork and/or other goods supplied by you or any third party as agreed. Such secure area(s) will be provided at your own expense (where the cost thereof is not included in the agreed price ) and for the avoidance of doubt Fenland Frames accepts no liability for such property whilst in the secure area(s)
Ownership.
Ownership of the goods supplied by Fenland Frames will pass from them to you when the agreed price and any monies outstanding from you to Fenland Frames are paid in full.
Force Majeure. Fenland Frames will not be held liable for any failure to supply the agreed goods and services by reason of any event beyond their reasonable control.
Variation. No variation of these Terms of Trade and no oral stipulations or representations will be binding on Fenland Frames unless expressly agreed to in writing.
Whilst we attempt to be as accurate as possible with the information on the website, there is always a risk of human error and we cannot be held liable for any inaccuracies arising as a result. We will use all reasonable endeavours to correct errors and omissions as quickly as is practical.
Please be aware that the content of the web site shows material finish and colours as accurately as possible. However, batches of material can vary in all respects as does the colour calibration and quality of computer monitors. For these reasons, if exact colour, material or other specification is important to you we suggest you contact us for advice prior to ordering as we cannot accept responsibility after the goods have been delivered.
